Welcome to The Posture Clinic. These Terms and Conditions ("Terms") govern your use of this website (the "Site") and your relationship with The Posture Clinic ("Posture Clinic," "we," "us," or "our"). By accessing or using the Site, or by receiving services or communications from us, you agree to be bound by these Terms, our Privacy Policy, and any additional terms that apply to specific services. If you do not agree, please do not use the Site.

We may update these Terms from time to time. Revised Terms will be posted on this page with an updated Effective Date, and your continued use of the Site constitutes acceptance of those changes.

1. Not a Substitute for In-Person Medical Care

The information provided on this Site — including descriptions of conditions, treatments, protocols, technologies, and educational content — is for general informational purposes only and is not a substitute for professional medical advice, diagnosis, or treatment.

Content on this Site does not create a provider–patient relationship. A provider–patient relationship is established only through a scheduled evaluation and in-person or telehealth care at our clinic. Always seek the advice of your physician or other qualified healthcare provider with any questions you may have regarding a medical condition. Never disregard professional medical advice or delay seeking it because of something you have read on this Site. If you think you may have a medical emergency, call 911 or your local emergency number immediately.

Individual results vary. We make no guarantee regarding the outcome of any treatment, protocol, or program. Descriptions of results reflect the experiences of specific individuals and should not be interpreted as a promise or guarantee of any particular outcome for you.

2. Appointments, Scheduling, and Communications

By providing your contact information to Posture Clinic — whether through this Site, by phone, in person, or otherwise — you consent to receive communications from us related to your care, scheduling, and our services, including by phone, email, and text message as described in the SMS/Text Messaging Terms section below.

Specific appointment, cancellation, no-show, and payment policies may apply to your care and will be provided to you directly by our clinic. Those policies are incorporated into these Terms by reference.

3. SMS/Text Messaging Terms

Program Description. By providing your mobile phone number and opting in to receive text messages from Posture Clinic, you consent to receive SMS/text messages related to appointment reminders, treatment and care updates, clinical communications, and promotional or educational content about our services.

Message Frequency. You may receive up to one (1) message per day. Actual frequency will vary based on your interactions with our clinic, such as appointment scheduling and reminders.

Message and Data Rates. Message and data rates may apply. Any charges are determined by your mobile carrier and your specific plan. Please contact your wireless provider for details about your messaging and data plan.

Opting Out. You may opt out of receiving text messages at any time by replying STOP to any message you receive from us. After you send STOP, you will receive a confirmation message, and no further text messages will be sent to you unless you opt in again.

Help and Assistance. For assistance, reply HELP to any message you receive from us, or contact our support team directly at 727-685-8464 or clinic@postureclinic.com.

We will never sell or share your mobile information with third parties for their marketing purposes. Carriers are not liable for delayed or undelivered messages.

4. Privacy and Protected Health Information

Your privacy is important to us. Our collection and use of personal information submitted through this Site is governed by our Privacy Policy. Protected health information created or received in the course of your care is handled in accordance with applicable law, including the Health Insurance Portability and Accountability Act (HIPAA) and any Notice of Privacy Practices we provide to you.

Please do not send detailed personal health information through unsecured channels such as website contact forms, standard email, or text message. These channels are not intended for sensitive medical information.

5. Intellectual Property

This Site and all materials available on it — including text, graphics, logos, images, protocols, and educational content — are the property of Posture Clinic and/or its licensors and are protected by copyright, trademark, and other intellectual property laws. The Site is provided for your personal, non-commercial use.

Except as expressly authorized, you may not modify, copy, reproduce, republish, upload, post, transmit, sell, create derivative works from, or distribute any material from the Site in any manner or medium. You may download or print one copy of individual pages for your personal, non-commercial use, provided you keep intact all copyright and other proprietary notices.

You may link to the Site so long as the link does not imply any sponsorship or endorsement by us. You may not frame or inline-link our content, or incorporate our material into another website, without our prior written permission.

TO THE FULLEST EXTENT PERMITTED BY LAW, POSTURE CLINIC AND ITS OWNERS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THIS SITE OR ANY CONTENT ON IT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. BECAUSE SOME STATES DO NOT ALLOW CERTAIN LIMITATIONS OF LIABILITY, THE ABOVE LIMITATION MAY NOT APPLY TO YOU. IF YOU ARE DISSATISFIED WITH THE SITE, YOUR SOLE AND EXCLUSIVE REMEDY IS TO DISCONTINUE USING IT.

Nothing in these Terms limits or excludes any liability that cannot lawfully be limited or excluded, including liability arising from the professional healthcare services we provide.

10. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict-of-law principles. Any dispute arising out of or relating to these Terms or your use of the Site shall be brought exclusively in the state or federal courts located in Pinellas County, Florida, and you consent to the personal jurisdiction of those courts.

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be severed and the remaining provisions shall remain in full force and effect.
