01  Acceptance of Terms

Welcome to thepostureclinic.com (the "Site"), operated by The Posture Clinic, a chiropractic clinic located at 6425 53rd St N Ste 6, Pinellas Park, FL 33781. By accessing or using the Site, you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, please do not use the Site. 

These Terms apply to all visitors, users, and others who access or use the Site. If you are a current patient of The Posture Clinic, your in-clinic patient agreement governs your treatment relationship; these Terms govern your use of the website only.

02  No Doctor-Patient Relationship

Visiting this Site, reading any content on this Site, watching any video, downloading any document, or submitting an application through this Site does not create a doctor-patient relationship between you and The Posture Clinic, Dr. Mark T. Wade, Dr. Krista Burns, or any other clinician affiliated with the clinic. 

A doctor-patient relationship is only established after (1) you complete a paid Patient Interview, (2) you are accepted as a patient, (3) you sign the clinic-issued patient agreement and consent forms in person, and (4) treatment begins. 

Until those four steps are complete, all content on this Site is offered as general education only and is not a substitute for an in-person evaluation by a qualified healthcare provider.

03  Use of the Site

You may use the Site for lawful, personal, non-commercial purposes. You agree not to: 

• Use the Site in any way that violates federal, state, or local law 
• Attempt to gain unauthorized access to any portion of the Site, server, or related systems 
• Use any automated means (bots, scrapers, crawlers) to access the Site without our written permission Interfere with or disrupt the operation of the Site or the servers and networks that host it 
• Transmit any virus, worm, malware, or other malicious code through the Site 
• Use the Site to harvest or collect personal information about other users 
• Misrepresent your identity or affiliation when submitting any form on the Site Reproduce, duplicate, copy, sell, resell, or exploit any portion of the Site for commercial purposes 
• Frame or mirror any portion of the Site without our prior written consent 

We reserve the right to refuse service, terminate access, or remove content at our sole discretion if these Terms are violated.

04  Intellectual Property

All content on the Site · including text, graphics, logos, images, videos, audio, scoring frameworks (such as the Optimal Vitality Score, the five-domain assessment, and the Align/Retrain/Mobilize phase model), educational diagrams, patient-facing protocols, and the overall "look and feel" of the Site · is the property of The Posture Clinic or its licensors and is protected by United States copyright, trademark, and other intellectual property laws. 

"The Posture Clinic," "Optimal Vitality Score," "OVS," and related names, logos, and slogans are trademarks or service marks of The Posture Clinic. 

You may not use these marks without our prior written permission. You are granted a limited, revocable, non-exclusive, non-transferable license to view and print content from the Site for your personal, non-commercial use only. Any other use · including reproduction, modification, distribution, transmission, republication, display, or performance · is strictly prohibited without our prior written consent.

05  Applications and the Patient Interview

The Site allows you to submit an application to be considered for our program. The application form collects your name, email address, and phone number. Submitting the application does not guarantee acceptance as a patient. 

The Patient Interview fee is $200 at application plus $200 only if you are accepted as a patient. The $200 application fee is charged when you submit your application and reserves your Patient Interview slot. If you are accepted as a patient at the conclusion of the Patient Interview, an additional $200 is charged · for a total of $400. If you are not accepted, no additional charge is made and your application fee is retained as payment for the Patient Interview consultation already provided. 

Acceptance decisions are made on the Patient Interview call. Acceptance is at the sole discretion of the clinician conducting the interview and is based on whether the program is appropriate for the applicant's presentation. Not every applicant is a fit for the program. 

Program fees, financing options (including third-party CareCredit financing), and the Longevity membership are described on the Investment & Plans page of the Site. All fees are subject to the patient agreement signed in clinic.

06  Content Is General Education · Not Medical Advice

All content on this Site · including blog posts, videos, downloadable PDFs, case examples, scoring frameworks, exercise descriptions, and protocol overviews · is provided for general educational and informational purposes only.

Nothing on this Site constitutes medical advice, diagnosis, treatment, or a recommendation for a specific course of action. Always consult a qualified healthcare provider before starting, stopping, or modifying any treatment, exercise program, supplement regimen, or medication. 

Case examples shown on this Site are composites · they illustrate the kinds of presentations and outcomes we see across multiple patients. They are not testimonials, and they are not predictions of what any individual patient will experience. Individual results vary. See our Medical Disclaimer for full detail.

07 Third-Party Links and Services

The Site may contain links to third-party websites, services, or resources that are not owned or controlled by The Posture Clinic. We provide these links as a convenience and do not endorse and are not responsible for the content, privacy practices, or practices of any third-party site or service. 

The Site uses third-party service providers to operate certain functions · for example, payment processing for the Patient Interview application fee, scheduling, financing through CareCredit, email delivery, and analytics. Your use of those services is governed by the third party's own terms and privacy policy. 

CareCredit financing, if you choose to apply, is offered by a third-party lender. Approval, terms, interest rates, and account servicing are handled entirely by CareCredit. The Posture Clinic is not a party to your CareCredit agreement.

09  Disclaimers · No Warranties

THE SITE AND ALL CONTENT, MATERIALS, AND SERVICES PROVIDED THROUGH THE SITE ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. 

To the fullest extent permitted by Florida law, The Posture Clinic disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranty arising from course of dealing or usage of trade. We do not warrant that (a) the Site will be uninterrupted, secure, or error-free; (b) defects will be corrected; (c) the Site is free of viruses or other harmful components; or (d) the results obtained from use of the Site or its content will meet your requirements. 

We make no warranty regarding the accuracy, completeness, or currency of any health, clinical, or educational content on the Site. Health science evolves. While we keep content current to the best of our ability, you should not rely on this Site as a sole source of clinical information.

10  Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY FLORIDA LAW, THE POSTURE CLINIC, ITS OWNERS, EMPLOYEES, CONTRACTORS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SITE OR ITS CONTENT. 

In no event shall our total cumulative liability to you for all claims arising from or related to your use of the Site exceed the greater of (a) the total amount you paid to The Posture Clinic in the 12 months immediately preceding the event giving rise to the claim, or (b) one hundred U.S. dollars ($100). 

Some jurisdictions do not allow the exclusion or limitation of certain damages. In those jurisdictions, our liability is limited to the maximum extent permitted by law. 

Nothing in this section limits liability for in-clinic professional services. Professional liability for chiropractic care delivered in clinic is governed by the patient agreement and applicable Florida law.

11  Indemnification

You agree to indemnify, defend, and hold harmless The Posture Clinic and its owners, employees, contractors, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with (a) your access to or use of the Site, (b) your violation of these Terms, (c) your violation of any third-party right, including any intellectual property or privacy right, or (d) any content you submit, post, or transmit through the Site.

12  Governing Law and Venue

These Terms are governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of laws provisions. 

Any dispute arising out of or relating to these Terms or your use of the Site shall be resolved exclusively in the state or federal courts located in Pinellas County, Florida. You consent to the personal jurisdiction of those courts and waive any objection based on inconvenient forum. 

Nothing in this section prevents either party from seeking injunctive relief in any court of competent jurisdiction for the protection of intellectual property or confidential information.

13  Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top of this page. Material changes will be highlighted with a notice on the Site for a reasonable period. Your continued use of the Site after changes take effect constitutes acceptance of the revised Terms. If you do not agree to the revised Terms, please stop using the Site.

14  Severability and Waiver

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision of these Terms is not a waiver of that right or provision. No waiver is effective unless in writing and signed by an authorized representative of The Posture Clinic.

15  Entire Agreement

These Terms, together with the Privacy Policy, Medical Disclaimer, and Accessibility Statement posted on the Site, constitute the entire agreement between you and The Posture Clinic regarding use of the Site. They supersede any prior agreements or communications regarding the same subject matter. For patients of the clinic, the in-clinic patient agreement and consent forms govern the doctor-patient relationship and treatment; those documents control if there is any conflict with these Terms regarding clinical care.
